Court refuses application for Seun Kuti?s arraignment by the police

 

An application by the police to formally arraign afrobeat singer, Seun Kuti has been turned down by a Sabo-Yaba Chief Magistrates’ Court in Lagos State.

 

Mr Cyril Ejiofor who led a police legal team to court on Wednesday, May 24, hours after the singer was released from police custody, had applied to the court to allow the arraignment of the singer. He said that the application was to formally bring charges against Kuti.

Kuti’s lawyer, Mr Femi Falana (SAN), however, opposed the application on grounds of the police refusing to send the case file to Lagos State Director of Public Prosecutions (DPP) for advice, as directed by the Chief Magistrate, Mrs Adeola Olatubosun.

 

Falana who stated that the police cannot prosecute and investigate at the same time, averred that the order given by the court should not be disregarded.

 

Before adjourning the case till July 3 for mention, Chief magistrate Olatubosun noted that she needs the DPP’s advice before proceeding with the case.
