Former Governor of the Central Bank of Nigeria, Godwin Emefiele, has finally returned to his residence in Abuja after spending 151 days in detention following his release on bail by a court in the Federal Capital Territory.
The ruling was delivered by the High Court of the Federal Capital Territory, sitting in Maitama, despite objections raised by both the Economic and Financial Crimes Commission and the Office of the Attorney General of the Federation.
Court Orders Immediate Release
Presiding judge Olukayode Adeniyi ruled that the continued detention of the former CBN chief without trial could not be justified.
He emphasized that prolonged incarceration without formal trial proceedings violates legal principles and cannot continue indefinitely.
The judge therefore ordered that Emefiele be released into the custody of his legal representatives while awaiting further court proceedings.
Conditions Attached to Bail
As part of the bail conditions, the court directed the former apex bank governor to surrender all his international passports and travel documents to the court registrar.
His legal team was also mandated to ensure that he appears in court whenever required, particularly when the charges against him are formally heard.
Background of the Case
Emefiele had been held by security agencies since mid-2023 after being suspended from office by Bola Tinubu.
He was initially arrested by the Department of State Services before later being transferred to the custody of the Economic and Financial Crimes Commission.
The Federal Government subsequently filed multiple charges against him, including allegations of illegal possession of firearms and ammunition as well as corruption-related offences.
Court Questions Detention Process
In his ruling, Justice Adeniyi noted that the court had previously ordered authorities to either release Emefiele or produce him before the court so that his bail request could be considered.
According to the judge, the failure to comply with that earlier order ultimately led to Wednesday’s proceedings where the former CBN governor was finally presented in court.
The court also questioned the validity of a remand order presented by government lawyers, noting inconsistencies in the dates contained in the document.
Next Court Date
Following the bail decision, the court adjourned the matter for further proceedings while awaiting Emefiele’s formal arraignment.
Although the former CBN chief has now returned home, his legal battles are far from over, as he is still expected to face trial over several allegations filed by the Federal Government.
